PROTOKÓŁ
między Rządem Rzeczypospolitej Polskiej a Rządem Republiki Mołdawii dotyczący obowiązywania w stosunkach między Rzecząpospolitą Polską a Republiką Mołdawii dwustronnych umów międzynarodowych zawartych między Rzecząpospolitą Polską (Polską Rzecząpospolitą Ludową) a Związkiem Socjalistycznych
Republik Radzieckich w latach 1944-1991,
podpisany w Warszawie dnia 9 października 2015 r.
Rząd Rzeczypospolitej Polskiej i Rząd Republiki Mołdawii, zwane dalej „Umawiającymi się Stronami”,
Dążąc do określenia zakresu stosunków traktatowych między obydwoma Państwami,
Pragnąc uregulować status prawny umów zawartych w latach 1944 — 1991 między Rzecząpospolitą Polską (Polską Rzecząpospolitą Ludową) a Związkiem Socjalistycznych Republik Radzieckich w stosunkach między Rzecząpospolitą Polską a Republiką Mołdawii,
Uzgodniły, co następuje:
Artykuł 1
Moc obowiązującą w stosunkach między Rzecząpospolitą Polską a Republiką Mołdawii zachowuje następująca umowa:
Umowa między Rządem Polskiej Rzeczypospolitej Ludowej a Rządem Związku Socjalistycznych Republik Radzieckich o współpracy w zapobieganiu aktom bezprawnej ingerencji w działalność lotnictwa cywilnego, podpisana w Moskwie dnia 8 kwietnia 1987 roku (z wyjątkiem pkt II Protokołu do Umowy).
Artykuł 2
Umawiające się Strony stwierdzają, że umów niewymienionych w Artykule 1, zawartych między Rzecząpospolitą Polską (Polską Rzeczpospolitą Ludową) a Związkiem Socjalistycznych Republik Radzieckich w latach 1944 - 1991, nie stosuje się w relacjach między Rzecząpospolitą Polską a Republiką Mołdawii i tym samym uważa się je za wygasłe.
Artykuł 3
Protokół niniejszy podlega przyjęciu zgodnie z prawem każdej z Umawiających się Stron, co zostanie stwierdzone w drodze wymiany not. Protokół wejdzie w życie w dniu, który nastąpi po dniu otrzymania noty późniejszej.
Sporządzono w. iJo/rMZaai.e. dnia.. £ <2<ftTroku, w dwóch egzemplarzach,
każdy w językach polskim, rumuńskim i angielskim, przy czym wszystkie teksty mają jednakową moc. W razie rozbieżności przy ich interpretacji, tekst w języku angielskim uważany będzie za rozstrzygający.

Guvemul Republicii Polone §i Guvemul Republicii Moldova, denumite in continuare „P3r{i Contractante”,
Dorind sa determine scopul cadrului juridic al rela^iilor dintre cele doua State,
Dorind sa reglementeze statutul juridic al acordurilor incheiate in anii 1944 - 1991 intre Republica Polona (Republica Populara Polona) §i Uniunea Republicilor Sovietice Socialiste, in relafiile dintre Republica Polona §i Republica Moldova,
Au convenit asupra urmatoarelor prevederi: Articolul 1
Urmatorul acord va continua sa fie aplicat in rela^iile dintre Republica Polona §i Republica Moldova:
Acordul intre Guvemul Republicii Populare Polone §i Guvemul Uniunii Republicilor Sovietice Socialiste privind cooperarea in domeniul suprimarii actelor ilegale de imixtiune in activitatea avialiei civile, incheiat la Moscova la 8 aprilie 1987 (cu exceplia punctului II din Protocolul la Acord). Articolul 2
Parjile Contractante recunosc ca acordurile incheiate intre Republica Polona (Republica Populara Polona) §i Uniunea Republicilor Sovietice Socialiste in anii 1944 - 1991, care nu au fost menfionate la Articolul 1, nu au fost aplicate in relafiile dintre Republica Polona §i Republica Moldova §i, prin urmare sunt considerate ca fiind stinse.
Articolul 3
Prezentul Protocol va fi aprobat in conformitate cu legislafia fiecarei P5r{i Contractante, notificarile relevante fiind efectuate printr-un schimb de notę. Protocolul va intra in vigoare in urmatoarea zi dupa recepfionarea ultimei notificiSri.

between the Government of the Republic of Poland and the Government of the Republic of Moldova concerning the applicability, in relations between the Republic of Poland and the Republic of Moldova, of bilateral international agreements concluded between the Republic of Poland (the Polish People’s Republic) and the Union of the Soviet Socialist Republics in the years 1944 -1991.
The Govermnent of the Republic of Poland and the Govemment of the Republic of Moldova, hereinafter referred to as the “Contracting Parties”,
Desiring to determine the scope of treaty-based relations between the two States,
Desiring to regulate the legał status of agreements concluded in the years 1944 - 1991 between the Republic of Poland (the Polish People’s Republic) and the Union of the Soviet Socialist Republics, in relations between the Republic of Poland and the Republic of Moldova,
Have agreed upon the following provisions: Article 1
The following agreement shall condnue to apply in relations between the Republic of Poland and the Republic of Moldova:
The Agreement between the Govemment of the Polish People’s Republic and the Govemment of the Union of the Soviet Socialist Republics concerning cooperation in the suppression of unlawful acts against the safety of civil aviation, done at Moscow on 8 April, 1987 (with exception of point II of the Protocol to the Agreement). Article 2
The Contracting Parties acknowledge that agreements concluded between the Republic of Poland (the Polish People’s Republic) and the Union of the Soviet Socialist Republics in the years 1944-1991 which have not been referred to in Article 1, have not been applied in relations between the Republic of Poland and the Republic of Moldova and therefore are considered to be terminated.
Article3
This Protocol shall be adopted pursuant to the laws of each of the Contracting Parties and acknowledged through an exchange of notes. The Protocol shall enter into force on the day following the day of the reception of the later notę.
