MEMORANDUM O POROZUMIENIU (MOU)

między Ministrem Środowiska Rzeczypospolitej Polskiej a Ministerstwem Zasobów Naturalnych i Środowiska Socjalistycznej Republiki Wietnamu o współpracy w dziedzinie zasobów naturalnych i środowiska,

podpisane w Hanoi dnia 28 listopada 2017 r.

Minister Środowiska Rzeczypospolitej Polskiej i Ministerstwo Zasobów Naturalnych i Środowiska Socjalistycznej Republiki Wietnamu, zwane dalej „Stronami”,

uznając wagę, jaką Rządy Rzeczypospolitej Polskiej i Socjalistycznej Republiki Wietnamu przywiązują do umacniających się relacji dwustronnych;

uznając wspólną odpowiedzialność za ochronę środowiska i globalnego klimatu, a także zrównoważone wykorzystanie zasobów naturalnych;

żywiąc przekonanie o znaczeniu ochrony środowiska i poprawy jego stanu, a także zrównoważonego wykorzystania zasobów naturalnych i ich zachowania dla przyszłych pokoleń;

wyrażając wspólne zainteresowanie poszukiwaniem wszelkich możliwości współpracy na rzecz realizacji wspólnych celów;

uzgodniły, co następuje:

Artykuł 1

Strony będą współpracować w dziedzinie zasobów naturalnych i środowiska, a także wspierać taką współpracę pomiędzy instytucjami, organizacjami, ośrodkami badawczymi, uczelniami i przedsiębiorstwami obu krajów w obszarach i formach określonych poniżej, na zasadzie równości i wzajemnych korzyści, z poszanowaniem różnic w rozwoju oraz polityk ochrony środowiska i zasobów naturalnych w krajach obu Stron.

Artykuł 2

Obszary współpracy obejmują:

1)    wymianę doświadczeń dotyczących regulacji prawnych i polityk w dziedzinie zasobów naturalnych i środowiska;

2)    badania naukowe w dziedzinie środowiska i zasobów naturalnych;

3)    dialog polityczny dotyczący zasobów naturalnych i środowiska;

4)    wykorzystanie instrumentów ekonomicznych w gospodarowaniu zasobami naturalnymi;

5)    monitoring środowiska;

6)    ochronę powietrza;

7)    ochronę wód powierzchniowych i podziemnych;

8)    ochronę i przywracanie krajobrazów i ekosystemów oraz ochronę różnorodności biologicznej, w tym ochronę i zrównoważone wykorzystanie różnorodności biologicznej na obszarach chronionych;

9)    promocję zrównoważonej produkcji i konsumpcji;

10)    kontrolę zanieczyszczeń;

11)    technologie środowiskowe, w tym technologie usuwania zanieczyszczeń ze środowiska i zielone technologie;

12)    edukację ekologiczną;

13)    zmiany klimatu, w szczególności:

a)    działania z zakresu łagodzenia skutków i adaptacji;

b)    opracowywanie i wdrażanie krajowych strategii i polityk;

c)    zmniejszenie emisji gazów cieplarnianych spowodowanej wylesianiem i degradacją lasów;

14)    badania geologiczne, ochronę zasobów i ich racjonalne wykorzystanie;

15)    badania pod kątem geologii środowiskowej i zagrożeń geologicznych na rzecz planowania rozwoju społeczno-gospodarczego;

16)    inne wzajemnie wybrane tematy pozostające w sferze wspólnego zainteresowania.

Artykuł 3

Uwzględniając swoje potrzeby i możliwości, Strony określają następujące formy współpracy:

1)    wymianę informacji i doświadczeń w obszarze zasobów naturalnych i środowiska;

2)    prowadzenie wspólnych badań podstawowych i stosowanych w obszarze zasobów naturalnych i środowiska;

3)    wspieranie rozwoju technologii przyjaznych ochronie środowiska, w tym dotyczących usuwania zanieczyszczenia środowiska i zielonych technologii, a także technologii przyczyniających się do adaptacji do zmian klimatu i łagodzenia ich skutków;

4)    wymianę naukowców, stypendystów, specjalistów i urzędników rządowych zaangażowanych w zarządzanie zasobami naturalnymi i środowiskiem;

5)    poszukiwanie odpowiednich źródeł finansowania, w tym pochodzących z międzynarodowych funduszy i instytucji finansowych, w celu realizacji wspólnych projektów dotyczących ochrony środowiska na terytorium Wietnamu na zasadzie obopólnych korzyści;

6)    inne wzajemnie uzgodnione formy współpracy.

Artykuł 4

1.    Zasady finansowania współpracy i realizacji wspólnych projektów w ramach niniejszego MOU rozpatrywane będą przez Strony w każdym indywidualnym przypadku stosownie do ich możliwości budżetowych i dostępności funduszy zewnętrznych, zgodnie z prawodawstwem ich państw.

2.    Poza uzgodnionymi przez Strony przypadkami, każda z umawiających się Stron ponosi swoje koszty powstałe w związku z realizacją niniejszego MOU.

3.    Niezależne od wspólnych projektów Stron, o których jest mowa w ustępie 1 niniejszego Artykułu, zachęca się inne instytucje, organizacje, ośrodki badawcze, uczelnie i przedsiębiorstwa z krajów obu Stron do współpracy w obszarach określonych w Artykule 2 w ramach niniejszego MOU.

4.    Strony nie odpowiadają za zobowiązania podmiotów, o których mowa w ustępie 3 niniejszego Artykułu, wynikających z zawartych przez nie umów i kontraktów.

Artykuł 5

W ciągu trzech miesięcy od wejścia w życie niniejszego MOU Strony powiadomią się nawzajem o wyznaczeniu koordynatorów odpowiedzialnych za organizację i ułatwianie wdrażania niniejszego MOU. Koordynatorzy będą utrzymywać wzajemne kontakty drogą elektroniczną i w formie pisemnej oraz opracują doroczne raporty dla Stron w celu przeglądu i ułatwiania bieżącej współpracy.

Artykuł 6

Żadne z postanowień niniejszego MOU nie będzie interpretowane z naruszeniem praw i obowiązków Stron wynikających z prawa międzynarodowego, szczególnie wcześniej zawartych przez Strony umów międzynarodowych lub umów związanych z ich członkostwem w organizacjach międzynarodowych.

Artykuł 7

Kwestie sporne dotyczące interpretacji lub stosowania niniejszego MOU będą rozstrzygane w drodze bezpośrednich konsultacji między Stronami.

Artykuł 8

1.    Niniejsze Memorandum o Porozumieniu wchodzi w tycie w dniu jego podpisania.

2.    Niniejsze MOU zostaje zawarte na okres pięciu lat i podlega automatycznemu przedłużeniu na kolejne okresy pięcioletnie, o ile żadna ze Stron nie wypowie go w drodze pisemnej noty z zachowaniem 6-miesięcznego okresu wypowiedzenia.

3.    Zmiany do niniejszego MOU będą wprowadzane zgodnie z prawem każdej ze Stron, w drodze wzajemnego pisemnego uzgodnienia między Stronami.

4.    Każda ze Stron może wypowiedzieć MOU w trakcie jego obowiązywania w drodze pisemnego zawiadomienia. Wygaśnięcie MOU jest skuteczne po upływie sześciu miesięcy od daty otrzymania odnośnego zawiadomienia przez drugą Stronę.

MEMORANDUM OF UNDERSTANDING (MOU) between

the Minister of the Environment of the Republic of Poland

and

the Ministiy of Natnral Resources and Environment of the Socialist Republic

ofVietNam on cooperation

in the field of natnral resources and environment

The Minister of the Environment of the Republic of Poland and the Ministiy of Natural Resources and Environment of the Socialist Republic of Viet Nam, hereinafter referred to as “Parties”,

Recognising the importance that govemments of the Republic of Poland and the Socialist Republic of Viet Nam attach to the growing bilateral relationship;

Recognising the common responsibility tor the protection of the environment and the global climate, as well as for the sustainable use of natural resources;

Cominced of the importance of protecting and improving the stale of the environment, as well as the sustainable use and protection of natural resources for futurę generations;

Expressing common interest in finding all possibilities of cooperation for the implementation of shared objectives;

have reached the following imderstanding:

Articlel

The Parties shall cooperate in the field of natural resources and environment, and shall support such cooperation between institutions, organisations, research centres, universities and enterprises of both coimtries, with the areas and forms of cooperation as specified below, on the basis of eąuality and mutual benefits, respecting the differences arising from the development, and environmental and natural resources policies in both countries of the Parties.

The areas of cooperation shall include:

1)    exchange of experience in terms of legał regulaiions and policies in the field of natural resources and envin>nment;

2)    scientific research in the field of environment and natural resources;

3)    political dialogue on natural resources and environment issues;

4)    use of economic instruments in the management of natural resources;

5)    monitoring of the environment;

6)    protection of air;

7)    protection of surfece and underground water,

8)    protection and restoration of landscapes and ecosystems and biodiversity conservation, incłuding conservation and sustainable use of biological diversity within protected areas;

9)    promotion of sustainable production and consumption;

10)    pollution control;

11)    environmental technologies, incłuding enviromnental pollution treatment and green technologies;

12)    environmental education;

13)    climate change, in particular:

a)    mitigation and adaptation activities;

b)    development and implementation of national strategies and policies;

c)    reduction of greenhouse gases emission caused by deforestation and forest degradation;

14)    geological survey, protection of resources and their rational use;

15)    enyironmental geology and geo-hazard survey for socio-economic development planning;

16)    other mutually selected subjects in the scope of common interesŁ

Taking into consideration their needs and capabilities, the Parties shall detennine the

following forms of cooperation:

1)    exchange of Information and experience in the field of natural resources «nH environment;

2)    implementation of joint basie and applied research in the field of natural resources and environment;

3)    support for the development of environmentally fiiendly technologies, incłuding environmental pollution treatment and green technologies, as well as clmmte

4)    exchange of scientists, scholars, professionals and govemmeut officials involved in the management of natural resources and environment;

5)    seeking suitable funding sources, incłuding those from intemational funds and financial institutions, to implement joint environment projects in Viet Nam based on mutual benefits;

6)    other mutually agreed forms of cooperation.

Article 4

1.    The principles of financing the cooperation and implementing common projects within this MOU shall be examined by the Parties in each individual case in accordance with their budgetary capacities and the availability of extemal funding, pursuant to the legislation of their countries.

2.    Apart firom cases agreed by the Parties, each contracting Party shall bear its own costs incurred in connection with the execution of this MOU.

3.    Regardłess of joint projects of the Parties referred to in paragraph 1 of this Article, other institutions, organisations, scientific research centres, universities and enterprises fiom both countries of the Parties are encouraged to cooperate in the areas specified in Article 2 and to be brought under the umbuęlla of this MOU.

4.    The Parties shall not be liable for the commitments of the entities refenred to in paragraph 3 of this Article, resulting ftom their agreements and contracts.

Article 5

Within three months after the entry of this MOU into force, the Parties notify each other on the appointment of coordinators responsible for the farllftation and organisation of tfae implementation of this MOU. The coordinators shall m«int»in mutual contact by electronic means and in writing and shall elaborate anwnal reports for the Parties m order to review and facilitate the ongoing cooperation.

Article 6

Nonę of the provisions of this MOU shall be construed to infiinge the rights and obligations of the Parties under intemational law, in particular, under the intemational agreements previously concluded by the Parties, or the agreements Associated with their membership in intemational organisations.

Article 7

Disputes regarding the interpretation ot application of this MOU shall be settled through direct consultations between the Parties.

Artide8

1.    This Memorandum of Understanding shall enter into force on the datę of its signing

2.    This MOU shall be concluded for a period of five years and is subject to automatic extension for successive periods of five years, unless one of the Parties renounces it by means of a notę in writing, maintaining a 6-month notice period.

3.    Amendments to this MOU shail be impiemented in accordance with the law of each Party, by means of mutual consent concluded in writing between the Parties.

4.    Each Party may terminale the MOU during the period of its validity by means of a written notice. The expiry of the MOU shall be effective after six months from the datę of the receipt of the relevant notification by the other Party.

5.    The termination of this MOU shall not affect the implementation of ongoing projects initiated under this MOU and unfinished upon its repeal.

copies, each in Polish, Vietnamese, and English, all texts being equally authentic. In case of divergences in iheir interpretation, the text in English shall prevail.
