UMOWA

między Rządem Rzeczypospolitej Polskiej a Rządem Państwa Katar o współpracy w dziedzinie kultury,

podpisana w Warszawie dnia 5 maja 2017 r.

Rząd Rzeczypospolitej Polskiej oraz Rząd Państwa Katar, zwane dalej „Stronami”, pragnąc rozwijać i umacniać współpracę w dziedzinie kultury,

świadome tego, że rozszerzenie współpracy w dziedzinie kultury przyczyniać się będzie do zacieśniania stosunków łączących oba Państwa, jak również do wzrostu wzajemnego zrozumienia,

uzgodniły, co następuje:

Artykuł 1

1.    W celu ułatwienia wymiany kulturalnej i umożliwienia prezentacji osiągnięć artystycznych, Strony będą wymieniać informacje o swojej infrastrukturze kulturalnej.

2.    Strony będą wspierać nawiązywanie kontaktów między zainteresowanymi instytucjami kultury obu Państw.

Artykuł 2

W celu wzajemnego poznania, Strony będą popierać działania na rzecz upowszechniania informacji o osiągnięciach kulturalnych Państwa drugiej Strony poprzez:

1)    umożliwianie wymiany artystów, twórców i specjalistów we wszystkich dziedzinach kultury;

2)    wspieranie udziału artystów i zespołów artystycznych w międzynarodowych konkursach i festiwalach odbywających się w obu Państwach;

3)    wspieranie inicjatyw translatorskich i wydawniczych ułatwiających upowszechnianie dzieł literackich autorów obu Państw;

4)    organizowanie koncertów, wystaw, spotkań i innych wydarzeń artystycznych.

Artykuł 3

1.    W dziedzinie kinematografii Strony będą wspierać:

1)    bezpośrednią współpracę narodowych archiwów filmowych oraz instytucji i stowarzyszeń filmowych w celu wymiany doświadczeń i informacji;

2)    realizację koprodukcji i wzajemne świadczenie usług przy produkcji filmów;

3)    organizację na zasadach wzajemności przeglądów filmowych;

4)    udział w międzynarodowych festiwalach filmowych organizowanych w Państwie drugiej Strony, zgodnie z regulaminami tych festiwali.

2.    Strony będą popierać współpracę w zakresie digitalizacji i udostępniania dziedzictwa filmowego i audiowizualnego.

3.    Strony będą sprzyjać realizacji wspólnych projektów w zakresie przemysłów kreatywnych.

Artykuł 4

1.    Strony będą popierać współpracę między bibliotekami narodowymi obu Państw w zakresie wymiany informacji i publikacji oraz zarządzania bibliotekami i wykorzystania w ich działalności nowoczesnych technologii, w szczególności w celu digitalizacji zbiorów.

2.    Strony będą sprzyjać prezentacji wydawnictw literackich i artystycznych na międzynarodowych targach książki organizowanych w obu Państwach.

Artykuł 5

Strony będą popierać współpracę w dziedzinie archiwistyki, w szczególności w zakresie udostępniania zbiorów dla celów naukowych, społecznych i prawnych, a także wymianę doświadczeń oraz specjalistycznych publikacji i kopii dokumentów, zgodnie z przepisami prawa obowiązującymi w obu Państwach.

Artykuł 6

Strony będą sprzyjać współpracy w dziedzinie dziedzictwa niematerialnego, w tym także udziałowi przedstawicieli drugiej Strony w festiwalach folklorystycznych oraz organizowaniu wystaw sztuki ludowej.

Artykuł 7

Strony będą współpracować na rzecz ochrony dziedzictwa kulturowego oraz wspierać inicjatywy zmierzające do zachowania i konserwacji zabytków światowego dziedzictwa kulturowego znajdujących się na terytorium obu Państw, w szczególności poprzez wymianę informacji i doświadczeń między właściwymi instytucjami oraz realizację wspólnych projektów badawczych oraz prac archeologicznych i konserwatorskich, a także organizację staży i programów szkoleniowych.

Artykuł 8

1.    Strony będą współpracować w celu niedopuszczenia do nielegalnego przywozu, wywozu i przenoszenia własności dóbr kultury stanowiących ich dziedzictwo kulturowe, zgodnie z przepisami prawa obowiązującymi w obu Państwach oraz konwencjami międzynarodowymi, których oba Państwa są stronami.

2.    Strony uznają, że dobra kultury nielegalnie wywiezione z terytorium Państwa jednej Strony i nielegalnie wwiezione na terytorium Państwa drugiej Strony podlegają zwrotowi.

Artykuł 9

1.    Strony będą popierać wymianę informacji w celu zapoznania się z programami nauczania w zakresie edukacji artystycznej.

2.    Strony będą sprzyjać rozwijaniu współpracy między uczelniami artystycznymi obu Państw, na podstawie bezpośrednich porozumień między nimi.

Artykuł 10

Strony będą współpracować w dziedzinie prawa autorskiego i praw pokrewnych.

Artykuł 11

Strony będą współdziałać na forum Organizacji Narodów Zjednoczonych dla Wychowania, Nauki i Kultury (UNESCO).

Artykuł 12

1.    Strony powołają Komisję Mieszaną, zwaną dalej „Komisją”.

2.    Komisja zbierać się będzie na przemian w obu Państwach, w terminach i miejscach uzgadnianych w drodze dyplomatycznej.

3.    Komisja będzie opracowywała i przyjmowała okresowe programy współpracy określające formy oraz warunki organizacyjne i finansowe wymiany kulturalnej, będzie oceniała stan realizacji niniejszej Umowy oraz będzie proponowała odpowiednie zalecenia.

Artykuł 13

Koszty finansowe wynikające z realizacji niniejszej Umowy pokrywane będę zgodnie z obowiązuj ącymi przepisami prawa i stosowanymi zasadami w obu Państwach oraz w ramach środków dostępnych w budżetach każdej ze Stron.

Artykuł 14

Kwestie sporne między Stronami wynikające z realizacji i interpretacji niniejszej Umowy będą rozstrzygane polubownie przez konsultacje i negocjacje, w drodze dyplomatycznej.

Artykuł 15

Postanowienia niniejszej Umowy mogą zostać zmienione za wzajemną zgodą Stron, wyrażoną w formie pisemnej. Takie zmiany wejdą w życie zgodnie z procedurą określoną w artykule 16 ustęp 1 niniejszej Umowy.

Artykuł 16

1.    Umowa niniejsza wejdzie w życie po upływie 30 dni od dnia otrzymania, w drodze dyplomatycznej, noty późniejszej, w której Strony poinformują się wzajemnie o zakończeniu wewnętrznych procedur prawnych niezbędnych do wejścia w życie niniejszej Umowy.

2.    Umowa niniejsza zawarta jest na okres czterech (4) lat i ulega ona automatycznemu przedłużeniu na dalsze czteroletnie (4) okresy, jeżeli żadna ze Stron nie notyfikuje drugiej Stronie, w drodze dyplomatycznej, swojego zamiaru wypowiedzenia niniejszej Umowy, najpóźniej na sześć (6) miesięcy przed upływem danego okresu.

3.    Jeżeli Strony nie postanowią inaczej, takie wypowiedzenie niniejszej Umowy nie wpłynie na realizowane programy współpracy i inne działania, do czasu ich zakończenia.

w językach polskim, arabskim i angielskim, przy czym wszystkie teksty są jednakowo autentyczne. W przypadku rozbieżności przy ich interpretacji tekst w języku angielskim uważany będzie za rozstrzygający.

Agreement

between

the Government of the Republic of Poland and

the Goyernment of the State of Qatar on the cooperation in the field of culture

The Govemment of the Republic of Poland and the Govemment of the State of Qatar, hereinafter referred to as „the Parties”,

desiring to develop and strengthen the cooperation in the field of culture,

being aware that the extension of the cooperation in the field of culture shall contribute to strengthening relations between both States and increase the mutual understanding,

have agreed as follows:

Article 1

1.    In order to facilitate cultural exchange and enable presentation of artistic achievements, the Parties shall exchange information about their cultural infiastructure.

2.    The Parties shall support establishing contacts between interested cultural institutions of both States.

Article 2

In order to allow mutual acąuaintance the Parties shall promote measures to disseminate information about cultural achievements of the other Party through:

1)    facilitating the exchange of artists, creators and specialists in all fields of culture;

2)    supporting the participation of artists and artistic groups in intemational competitions and festivals taking place in both States;

3)    supporting translation and publishing initiatives to facilitate dissemination of literary works of authors from both States;

4)    organising concerts, exhibitions, meetings and other artistic events.

Article 3

1. In the field of dnematography the Parties shall support:

1)    direct cooperation of national film archives as well as film institutions and associations aiming at exchange of experiences and information;

2)    co-production of films and mutual services for the production of films;

3)    organisation on mutual terms of films reviews;

4)    participation in intemational film festivals organised in the State of the other Party, in accordance with terms and rules of those festivals.

2.    The Parties shall support cooperation related to digitalisation and dissemination of the film and audio-visual heritage.

3.    The Parties shall encourage the implementation of joint projects in the field of creative industries.

Article4

1.    The Parties shall support the cooperation between national libraries of both States in the field of exchange of information and publications as well as management of libraries and application of modem technologies in their operations, in particular in order to digitalise collections.

2.    The Parties shall facilitate presentation of literaturę and artistic publishing houses at intemational book fairs organised in both States.

Article 5

The Parties shall encourage the cooperation in the field of archiving, in particular in relation to access to collections for scientific, social and legał purposes as well as exchange of experiences and professional publications and copies of documents, in accordance with the applicable national legislation in both States.

Article 6

The Parties shall promote the cooperation in the field of intangible heritage, including participation of representatives of the other Party in folk festivals and organisation of exhibitions of the folk art.

Article 7

The Parties shall cooperate for protection of the cultural heritage and support initiatives aiming at protection and preservation of monuments belonging to the world cultural heritage located in both States, in particular through the exchange of information and experiences between relevant institutions and implementation of joint research projects as well as archaeological and conservatory works and organisation of intemships and training programmes.

Article 8

1.    The Parties shall cooperate in order to prevent illegal import, export and transfer of ownership of cultural property representing their cultural heritage, in accordance with the applicable national legislation in both States and intemational conventions to which both States are parties.

2.    The Parties recognise that cultural property illegally exported from the territory of one Party and illegally imported into the territory of another Party shall be retumed.

Article 9

1.    The Parties shall support the exchange of information in order to leam teaching programmes in the field of artistic education.

2.    The Parties shall encourage development of cooperation between artistic universities of both States in accordance with agreements concluded between these institutions.

Article 10

The Parties shall cooperate in the field of copyright and neighbouring rights.

Article 11

The Parties shall cooperate in the forum of the United Nations Educational, Scientific

and Cultural Organization (UNESCO).

Article 12

1.    The Parties shall constitute a Joint Committee, hereinafter referred to as “the Committee”.

2.    The Committee shall meet altematively in both States, at times and places agreed between the Parties, through diplomatic channels.

3.    The Committee shall develop and accept interim cooperation programmes specifying form and organisational and financial framework of the cultural exchange, shall assess the status of implementation of this Agreement and propose appropriate recommendations.

Article 13

Financial costs arising from the implementation of this Agreement shall be covered in accordance with national legislation and the applicable rules of both States and within the framework of the available resources in budget of each Party.

Article 14

Any disputes between the Parties arising from the implementation or interpretation of this Agreement shall be settled amicably by consultation or negotiation, through diplomatic channels.

Article 15

The provisions of this Agreement may be amended by mutual consent in writing between the Parties. Such amendments shall enter into force according to the same procedures prescribed in Article 16 Paragraph 1 of this Agreement.

Article 16

1.    The Agreement shall enter into force after thirty (30) days from the datę of receipt of later notification by the Parties, through diplomatic channels, indicating the completion of the respective intemal legał procedures necessary for the entry into force of this Agreement.

2.    This Agreement shall remain in force for a period of four (4) years, and shall automatically be renewed for successive periods of four (4) years, unless one of the Parties notifies the other Party, through diplomatic channels, of its intention to terminate this Agreement at least six (6) months before the datę of its validity term.

3.    Such termination of this Agreement shall not affect the ongoing cooperation programmes and other activities imtil their completion, unless otherwise agreed by the Parties.
