UMOWA

między Rządem Rzeczypospolitej Polskiej a Rządem Państwa Katar o zniesieniu obowiązku wizowego dla posiadaczy paszportów dyplomatycznych i specjalnych,

podpisana w Warszawie dnia 5 maja 2017 r.

Rząd Rzeczypospolitej Polskiej i Rząd Państwa Katar, zwane dalej „Stronami",

-    PRAGNĄC zacieśnić przyjazne stosunki pomiędzy obydwoma krajami;

-    PRAGNĄC ułatwić wjazd, wyjazd oraz podróżowanie między obydwoma krajami ich obywatelom legitymującym się paszportami dyplomatycznymi i specjalnymi;

-    ZGODNIE z obowiązującymi przepisami prawa obydwu krajów;

uzgodniły, co następuje:

Artykuł 1 PASZPORTY

Przedmiotem niniejszej umowy są następujące paszporty:

1.    W Państwie Katar: paszporty dyplomatyczne i specjalne.

2.    W Rzeczypospolitej Polskiej: paszporty dyplomatyczne.

ARTYKUŁ2

ZWOLNIENIE Z OBOWIĄZKU WIZOWEGO

Obywatele jednej Strony legitymujący się paszportami, o których mowa w art. 1 umowy, wydanymi przez tę Stronę, są uprawnieni do wjazdu, wyjazdu i tranzytu przez terytorium drugiej Strony bez wiz wyłącznie przy korzystaniu z międzynarodowego przejścia granicznego tej Strony.

ARTYKUŁ3 PRAWO POBYTU

Obywatele jednej Strony legitymujący się paszportami, o których mowa w art. 1 umowy, mają prawo pobytu na terytorium drugiej Strony bez wiz przez okres nieprzekraczający 90 (dziewięćdziesięciu) dni w każdym okresie 180 (stu osiemdziesięciu) dni, z zastrzeżeniem art. 4.

ARTYKUŁ4

CZŁONKOWIE MISJI DYPLOMATYCZNYCH, URZĘDÓW KONSULARNYCH ORAZ PRZEDSTAWICIELE W ORGANIZACJACH MIĘDZYNARODOWYCH

1.    Obywatele każdej ze Stron, legitymujący się paszportami, o których mowa w art. 1 umowy, oddelegowani do pracy w misji dyplomatycznej, urzędzie konsularnym lub organizacji międzynarodowej z siedzibą na terytorium drugiej Strony, są uprawnieni do wjazdu na terytorium tej Strony bez konieczności ubiegania się o wydanie wizy. W dągu 90 (dziewięćdziesięciu) dni od dnia przyjazdu tych osób na terytorium drugiej Strony, na wniosek zainteresowanej misji dyplomatycznej zostaną im wydane, na czas ich pobytu służbowego, zezwolenia na pobyt na terytorium tej Strony.

2.    Uprawnienia, o których mowa w ustępie. 1, przysługują również członkom rodzin osób, o których mowa w tym ustępie, pod warunkiem że członkowie rodzin legitymują się paszportami, o których mowa w art. 1 umowy, oraz pozostają z takimi osobami we wspólnym gospodarstwie domowym.

S. Ministerstwa Spraw Zagranicznych Stron będą sobie wzajemnie notyfikować z odpowiednim wyprzedzeniem osoby, o których mowa w ustępach 1 i 2.

Artykuł 5

UPRAWNIENIA WŁADZ

1.    Obywatele obu Stron legitymujący się paszportami, o których mowa w art. 1 umowy, zobowiązani są do przestrzegania przepisów prawa drugiej Strony przy przekraczaniu jej granicy oraz przez cały okres swojego pobytu na jej terytorium.

2.    Każda ze Stron zastrzega sobie prawo do odmowy wjazdu lub do skrócenia pobytu na swoim terytorium obywatelowi drugiej Strony legitymującemu się paszportem, o którym mowa w art. 1 umowy, którego obecność na swym terytorium uzna za niepożądaną.

3.    Każda ze Stron ma prawo do odmowy wjazdu lub pobytu na swoim terytorium obywatelom drugiej Strony ze względów bezpieczeństwa narodowego oraz porządku lub zdrowia publicznego.

Artykuł 6

UTRATA LUB ZNISZCZENIE PASZPORTU

W przypadku, gdy obywatel jednej Strony utraci na terytorium drugiej Strony paszport, o którym mowa w art. 1 umowy, albo paszport taki ulegnie zniszczeniu na terytorium drugiej Strony, jest on zobowiązany niezwłocznie powiadomić o tym właściwe władze Państwa przyjmującego za pośrednictwem misji dyplomatycznej lub urzędu konsularnego swojego kraju, mającego siedzibę na terytorium Państwa przyjmującego, w celu podjęcia stosownych działań. Właściwa misja dyplomatyczna lub urząd konsularny wyda swojemu obywatelowi nowy dokument podróży uprawniający do powrotu do kraju jego pochodzenia, zgodnie z przepisami Państwa wysyłającego, oraz powiadomi o tym właściwe władze Państwa przyjmującego.

Artykuł 7

NOTYFIKACJA WZORÓW PASZPORTÓW

1.    Dla celów umowy, każda ze Stron przekaże drugiej Stronie drogą dyplomatyczną wzory wydawanych przez siebie paszportów dyplomatycznych i specjalnych nie później niż 30 (trzydzieści) od dnia podpisania umowy.

2.    Strony przekażą sobie drogą dyplomatyczną informacje o wzorach swoich nowych lub zmienionych paszportów dyplomatycznych lub specjalnych nie później niż 30 (trzydzieści) dni przed ich wprowadzeniem.

Artykuł 8 ZAWIESZENIE

1.    Każda ze Stron zastrzega sobie prawo do czasowego zawieszenia stosowania niniejszej umowy w całości lub części ze względu na bezpieczeństwo narodowe, bezpieczeństwo publiczne, porządek publiczny lub ochronę zdrowia publicznego.

2.    Decyzja o zawieszeniu, jak również o uchyleniu zawieszenia, o którym mowa w ust. 1 będzie niezwłocznie notyfikowana drugiej Stronie drogą dyplomatyczną.

Artykuł 9 ZMIANY

Każda ze Stron może wystąpić na piśmie, drogą dyplomatyczną, o dokonanie zmiany całości lub części niniejszej umowy. Każda zmiana umowy uzgodniona przez Strony wejdzie w życie w trybie przewidzianym w art. 11 umowy i będzie stanowić jego integralną część.

Artykuł 10

ROZSTRZYGANIE SPORÓW

Wszelkie rozbieżności lub spory wynikające z interpretacji lub wykonywania postanowień umowy będą rozstrzygane ugodowo drogą konsultacji lub negocjacji między Stronami bez odwoływania się do stron trzecich ani trybunału międzynarodowego.

Artykuł 11

WEJŚCIE W ŻYCIE, CZAS OBOWIĄZYWANIA I WYPOWIEDZENIE

1.    Umowa wchodzi w życie po upływie 30 (trzydziestu) dni od daty otrzymania drogą dyplomatyczną późniejszej z notyfikacji, którymi Strony informują się nawzajem o spełnieniu wewnętrznych wymogów prawnych niezbędnych do wejścia w życie umowy.

2.    Umowa zostaje zawarta na czas nieokreślony. Każda ze Stron będzie mogła wypowiedzieć umowę w drodze notyfikacji przekazanej drugiej Stronie drogą dyplomatyczną. W takim przypadku umowa utraci moc obowiązującą po upływie 90 (dziewięćdziesięciu) dni od otrzymania notyfikacji o jego wypowiedzeniu.

Na dowód powyższego niżej podpisani, należycie umocowani przez swoje odnośne rządy, podpisali niniejszą umowę.

w 2 (dwóch) jednobrzmiących egzemplarzach, każdy w językach: polskim, arabskim i angielskim, przy czym wszystkie teksty są jednakowo autentyczne. W przypadku różnic interpretacyjnych rozstrzygający będzie tekst w języku angielskim.

AGREEMENT

BETWEEN THE GOVERNMENT OF THE REPUBLIC OF POLAND AND THE GOVERNMENT OF THE STATE OF OATAR ON THE EXEMPTION FROM VISAS FOR HOLDERS OF DIPLOMATIC AND SPECIAL

PASSPORTS

The Government of the Republic of Poland and the Government of the State of Qatar, hereinafter referred to as the "Parties",

-    DESIRING to strengthen friendly relations between the two countries,

-    DESIRING to facilitate entry to, departure from, and travel between both countries for their citizens holding diplomatic and special passports,

-    PURSUANT to the applicable laws of both countries, have agreed as follows:

Article 1 PASSPORTS

The following passports are subject of this agreement:

1.    In the State of Qatar: valid diplomatic and special passports.

2.    In the Republic of Poland: valid diplomatic passports.

Article 2

EXEMPTION FROM VISAS

Citizens of one Party holding passports mentioned in Article 1 of this agreement, issued by that Party, shall have the right to enter, exit, and transit through the territory of the other Party without visas, only from the International border Crossing point of this party.

Article 3

THE RIGHT TO STAY

Citizens of one Party holding passports mentioned in Article 1 of this agreement shall have the right to stay without visas in the territory of the other Party for a maximum period of 90 (ninety) days in any 180 - day period (one hundred and eighty), subject to Article 4.

Article 4

MEMBERS OF DIPLOMATIC MISSIONS, CONSULAR POSTS AND REPRESENTATIVES IN INTERNATIONAL ORGANISATIONS

1.    Citizens of either Party holding passports mentioned in Article 1 of this agreement, assigned to work in a diplomatic mission, consular post or an international organization having its seat in the territory of the other Party, shall have the right to enter the territory of that Party without the need to apply for a visa. At the request of the interested diplomatic mission, the aforementioned citizens shall be issued a document legalizing their stay for the period of his/her official stay, within 90 (ninety) days from the datę of his/her arrival to the territory of that Party.

2.    The facilities envisaged in paragraph 1 shall apply to family members of the persons referred to in that paragraph, provided that they hołd passports mentioned in Article 1 of this agreement and form part of his/her household.

3.    The Ministries of Foreign Affairs of the Parties shall notify each other in due advance about persons referred to in paragraphs 1 and 2.

Article 5

POWERS OF AUTHORITIES

1.    The Citizens of both parties holding passports mentioned in Article 1 of this agreement shall observe the laws applicable in territory of the party while Crossing the border and throughout their stay in the territory of the other party.

2.    Each Party shall have the right to refuse entry or shorten the stay of a Citizen of the other Party holding passport mentioned in Article 1 of this agreement, whose presence in its territory is deemed undesirable.

3.    Each party has the right to deny the nationals of the other party entry into or stay on its territories for reasons pertaining to national security, generał order or generał health.

Article 6

LOSS OR DAMAGE OF A PASSPORT

In the event of loss of passport mentioned in Article 1 by a Citizen of one Party in the territory of the other Party, or in the event of damage to his/her passport in the territory of the other Party, this person shall immediately notify the relevant authorities of the receiving State through the diplomatic mission or consular post of his/her country of origin sited in the receiving State, so that they may take appropriate action. The relevant diplomatic mission or consular post will issue a new travel document to this person to enable him/her to return to the country of his/her origin, pursuant the laws of the sending State, and inform about it to the competent authorities of the receiving State.

Article 7

NOTIFICATION OF PASSPORT SPECIMENS

1.    For the purposes of this agreement, the Parties shall, through diplomatic channels, exchange current specimens of their diplomatic and special passports, no later than 30 (thirty) days after the signing of this agreement.

2.    The Parties shall, through diplomatic channels, exchange information on their new or amended specimens of diplomatic or special passports, no later than 30 (thirty) days before their official introduction.

Article 8 SUSPENSION

1.    Either Party shall have the right to temporarily suspend the implementation of this agreement in whole or in part for reasons of national security, public security, public order or public health.

2.    The suspension, as well as revocation of the suspension referred to in paragraph 1 of this Article shall be immediately notified to the other Party through diplomatic channels.

Article 9 AMENDMENTS

Either Party may request in writing, through diplomatic channels, amendment of the whole agreement or its part. Any amendment of the agreement, agreed to by the Parties, shall enter into force in accordance with the procedures provided for in article 11 of the agreement itself and shall form its integral part.

Article 10

SETTLEMENT OF DISPUTES

Any differences or disputes arising in connection with the interpretation or implementation of the provisions of this agreement shall be settled amicably, by way of consultations or negotiations between the Parties, without reference to third parties or an international court.

Artide 11

ENTRYINTO FORCE, DURATION AND TERMINATION OF THE AGREEMENT

1.    This agreement shall enter into force 30 (thirty) days after the datę of receiving, through diplomatic channels, the latter notification in which the Parties shall notify each other of the completion of all intemal legał procedures required for the entry into force of this agreement.

2.    This agreement is concluded for an indefinite period of time. Each Party may terminate this agreement by notification through diplomatic channels. In such event the agreement will expire after 90 (ninety) days from the datę of receiving the notification of termination.

In witness whereof the two undersigned who are duły authorized by their respective Governments have signed this agreement.

..... 1438 AH in 2 (two) original copies, each in the Polish, Arabie and

English languages, all texts being equally authentic. In case of any discrepancies in their interpretation, the English version shall prevail.
