Agreement

between the Govemment of the Republic of Poland and the United Nations Educational, Scientific and Cultural Organization (UNESCO) conceming the 41st session of the World Heritage Committee

The Govemment of the Republic of Poland (hereinafter referred to as “the Govemment”), represented by the Minister of Culture and National Heritage, and the United Nations Educational, Scientific and Cultural Organization (hereinafter referred to as “UNESCO”), represented by the Director-General;

Whereas the Govemment, in letter of 19 November 2015 that it addressed to the Director of the UNESCO World Heritage Centre, agreed to host the 41st session of the World Heritage Committee, and whereas UNESCO accepted, with appreciation, the ofFer of the Govemment;

The Govemment and UNESCO (hereinafter jointly referred to as “the Parties”) agree to the fiollowing:

I. NATURĘ AND SCOPE OF THE MEETING

Under the "Regulations for the generał dassification of the various categories of meetings convened by UNESCO", adopted by the General Conference at its 14th session (14 C/Resolution 23, amended at the 18th, 25th and 33rd sessions of the General Conference), this meeting comes under Category II, ”lntergovemmental meetings other than intemational corrferences of States".

The purpose of the meeting is the further implementation of the 1972 Convention conceming the Protection of the World Cultural and Natural Heritage (hereinafter referred to as “the Convention”):

II. PARTICIPATION

(i)    Chief Participante

The chief participants at the 41st session of the World Heritage Committee will be the representatives of the 21 members of the Committee.

(ii)    Representatiyes and Obsenrers

(a) States Parties to the Convention that are not members of the Committee may send representatiyes to this meeting, as obsen/ers.

(b)    Non-States Parties to the Convention that are Member States of UNESCO or of the United Nations also may be permitted by the Committee to attend the sessions of the Committee and of its Bureau as observers, upon written request.

(c)    A representative of the International Centre for the Study of the Preservation and Restoration of Cuitural Property (ICCROM), a representative of the International Council of Monuments and Sites (ICOMOS), a representative of the World Conservation Union (IUCN), and representatives of other selected intergovemmental or non-govemmental organizations with similar objectives, may attend the meetings of the Committee in an advisory capacity.

(d)    The United Nations and organizations of the United Nations system, as well as other intemational governmental and non-governmental organizations, permanent observer missions to UNESCO and non-profit-making institutions having activities in the fields covered by the Convention, may be authorized by the Committee to participate in the sessions of the Committee as observers, upon written request.

The total number of participants, including experts, representatives, observers and members of the UNESCO Secretariat, is expected to be 100 at the Bureau session and 2000 at the Committee session.

III. PLACE AND DATĘ OF THE MEETING

The meeting shall take place at the International Conferences & Entertainment ICE Kraków, Kraków, Republic of Poland from 2 to 12 July 2017.

IV. ORGANIZATION OF THE MEETING

The responsibility for the technical and materiał organization of the meeting shall be shared by the Government and UNESCO, on the basis of the attached Statement of Requirements (Annex).

However, nothing in the provisions of this Agreement shall prevent the two Parties from agreeing mutually to make such adjustments as may be desirable to ensure the proper organization of the meeting.

In order to facilitate the organization of the meeting, the Government shall, upon signature of this Agreement, designate a senior official to be responsible on its behalf and with due authority for liaison with the UNESCO Secretariat (CLT/HER/WHC/PSM and CLT/CCS), as well as for installation and operation of the various services to be provided at the place of the meeting. Ali matters conceming the technical and materiał organization of this meeting may, from then on, be handled through the liaison ołficer thus appointed.

V. PRMLEGES AND IMMUNITIES

The Govemment shall apply, in all matters relating to the meeting, the provisions of the Convention on the Privileges and Immunities of the Specialized Agencies of the United Nations, as well as Annex IV theieto relating to UNESCO.

VI. FACILITATION

In particular, the Govemment shall ensure that no restriction is placed upon the entry into, sojoum in, and departure from the territory of the Republic of Poland of all persons, of whatever nationality, entitled to attend the meeting by virtue of a decision of the appropriate authorities at UNESCO and in accordance with the Organization's relevant rules and regulations.

When it is necessary, participants will have to apply for a visa in accordance with applicable regulations.

VII. SECURITY

The Govemment shall be responsible for providing, at its expense, such police protection and security as may be required to ensure the efficient functioning of all pre-session meetings, meetings and sessions of the 41st session of the World Heritage Committee and any other meetings linked to the event, in a calm and serene ambiance and without interference of any kind.

Such police service shall be under the direct supenrision and control of a senior officer to be designated by the Govemment. He/She shall work in dose coordination and cooperation, including at distance, with the Senior Security Liaison Officer appointed by UNESCO for this purpose, so as to ensure a proper atmosphere of security and tranquility.

In accordance with the UNDSS Framework for Accountability, the UN Designated Official for Poland is responsible for the security of United Nations personnel, premises and assets throughout the country, and must be kept informed throughout the process. The names of the responsible officers for security shall be communicated to UNDSS by the Host Country and UNESCO respectively, not later than a month before the session.

Security within and outside the Conference Premises shall be the responsibility of the Host Country, in ciose coordination and cooperation with UNESCO.

VIII. DAMAGE AND ACCIDENTS

As long as the premises resenred for the meeting are at the disposal of UNESCO, the Govemment and UNESCO shall bear the risk of damage, in the same parts, to the premises, facilities and fumiture and shall assume and bear all responsibility and liability for accidents that may occur to persons present therein.

The Govemment shall adopt appropriate measures to ensure the protection, particularly against fire and other risks, of the abovementioned premises, facilities, fumiture and persons. In preparation of the meeting, the Govemment will cooperate with UNESCO, and fumish relevant information to UNESCO, in order to enable compliance with the domestic requirements of protection against fire (technical and organizational).

UNESCO shall bear all responsibility for any damage to persons and property caused by the fault of staff members or agents of the Organization.

IX. DISPUTE SETTLEMENT

Any dispute concerning the interpretation or implementation of this Agreement shall be settled by negotiation or in accordance with any other procedurę agreed upon by the Parties*

X. FINAŁ PROVISIONS

This Agreement may be modified by written agreement between the Govemment and UNESCO.

The Annex to this Agreement shall form an integral part hereof and, unless expressly provided otherwise, a reference to this Agreement constitutes, at the same time, a reference to the Annex hereto.

This Agreement shall enter into force on the datę of signature and shall remain in force for the duration of the session and for a period thereafter as is necessary for all matters relating to any of its provisions being settled. This Agreement shall be considered as terminated upon exchange of notifications to be issued by the Parties, confirming mutually that all obligations resulting from

its provisions, including financial obligations, have been implemented fully. In this case, the datę of the latter notification shall be considered as the datę of termination of the Agreement.
